1. Who we are and what this document covers
The Karbi app is operated by Deme Szabolcs Barnabás, sole proprietor (registration number: 57683711; tax number: 59636540-2-30; registered seat: 3321 Egerbakta, Felszabadulás utca 14/A, Hungary; e-mail: hello@karbiapp.com; registering authority: National Tax and Customs Administration of Hungary, register of sole proprietors). Referred to below as "we". Our details can be checked in the public register of sole proprietors. We do not run a telephone helpline; we keep in touch with you only by e-mail, at hello@karbiapp.com.
This document sets out the conditions for using the Karbi app and the services that belong to it, for the free and the paid parts alike. By using the app you accept these terms. Before you buy a subscription we draw your attention separately to the automatic renewal, to the daily fair-use limit on photo estimates, to the fact that the subscription belongs to your Karbi account, and to the fact that deleting the account does not cancel the subscription. If you do not agree with the terms, do not use the app.
The rules of data processing are not in this document: you can read about those in the privacy notice (karbiapp.com/privacy).
2. What Karbi does and what it does not do
Karbi is an informational nutrient estimator and log: from a photo or barcode it estimates a food's carbohydrate and fat content and logs it. It is not a medical device and does not give medical advice, diagnosis, treatment, or insulin-dosing recommendations. Estimates are informational, can be wrong, and the user verifies them.
Photo estimates are produced by artificial intelligence. The result is an estimate, not a measurement: it depends on the photo, on the food and on the model, and it can be imprecise or wrong. The values shown are about the food, not about you: the app does not measure, predict or assess anything about your body or your state of health. Do not base a health decision on the app's data; for such questions turn to a healthcare professional.
People under 16 may use Karbi only under the supervision of a parent or guardian. A user under 18 may start a paid subscription only with the approval of their parent or guardian. Google Play's family and purchase-approval rules also apply.
3. Free use
The app's core features are free: manual logging, barcode lookup, custom foods, favourites, statistics, CSV export, cloud sync and the home-screen widget. A one-off, limited allowance of photo estimates is free: without registration, 3 estimates in total on one device, and reinstalling the app does not start this again; with a Karbi account, 8 estimates in total per account. This allowance does not renew. Once it is used up, photo estimates are available with the Karbi Fotó subscription; every other feature stays free. You can read about the device identifier needed to prevent abuse in the privacy notice.
We may change the conditions of the free allowance, but this applies only to people who start using the app after the change: we do not reduce an allowance you have already been given; in the event of a security abuse or an obvious counting error we may correct a faulty credit.
4. The Karbi Fotó subscription
Karbi Fotó is a paid subscription that gives you two things: photo estimates without a running allowance (subject to the fair use described in section 8), and the printable PDF summary. The subscription requires a Karbi account, because it belongs to the account and not to the device.
You can buy the subscription only through Google Play. The merchant of the purchase and the processor of the payment is the Google company named on the Google Play interface; we operate the Karbi service. Before the purchase, Google Play shows you the current price, the billing period, any trial period or discount, the taxes and the date of the next charge. The subscription renews automatically until you cancel it. The receipt or invoice for the purchase is issued by Google, not by us; you will find it in the Google Play app under Payments and subscriptions, and in the e-mail you receive at the time of purchase. Google Play's terms also apply to the purchase, the billing, the renewal, the cancellation and the refund, and you carry out these steps on the Google Play interface:
Cancellation: you can cancel the subscription in Google Play: Google Play app → Payments and subscriptions → Subscriptions → Karbi Fotó → Cancel subscription. Cancelling stops the next automatic renewal; access normally remains until the end of the current, already paid period, and Google Play shows the exact date. Cancelling on its own does not come with a refund, but this does not affect your right of withdrawal, your rights arising from defective performance, or Google Play's refund rules.
Trial period: if Google Play offers a trial period, it shows you its length, the price payable after the trial and the date of the first charge before the purchase. If you do not cancel the subscription before the trial ends, Google Play starts the paid period on the conditions it showed you.
Refund: you can ask for Google Play's voluntary refund options on the Google Play interface. If the service is defective, or if you have a right of withdrawal or another right to a refund under the law, you can also tell us at hello@karbiapp.com; we help with checking the entitlement and with settling the payment that Google handles. Google Play's own rules do not limit your statutory consumer rights.
Price change: Google Play informs you about a price change before it takes effect. From that notice you can see when the new price applies, whether your separate acceptance is needed, and how you can cancel the subscription. The new price does not change a period you have already paid for.
Access to the paid features is given by a purchase that Google confirms as active or in a grace period; if Google reports another state, the account works under the rules of the free tier. One purchase can be linked to one Karbi account, and you can use it on the compatible devices where Karbi is available.
If the subscription ends, your log, your settings and your synced data remain. You cannot create new PDF summaries, and you can use photo estimates under the rules of the free allowance. We do not delete PDF files you have already downloaded from your device.
5. How the subscription is concluded
You start the subscription on Google Play's purchase interface. Before the purchase, Google Play shows you the total price payable, the taxes, the billing period, the trial period or discount, the automatic renewal and the way to cancel. Before you send the order you can go back and correct the details you have entered.
The payment obligation arises when you approve it with Google Play's clearly marked purchase button. Google Play sends a confirmation of the purchase in a durable form.
The contract is concluded electronically. We do not file it individually, so it is not accessible later as a filed contract; you can, however, save these terms permanently, and we make earlier versions available too. The language of the contract is Hungarian. We have not subjected ourselves to a code of conduct.
The contract is concluded for an indefinite term, with an automatically renewing subscription. There is no minimum subscription period: you can stop the next renewal at any time on the Google Play interface. Cancelling on its own does not shorten the current, already paid period.
6. Technical conditions
Using Karbi requires a compatible Android device, an internet connection and a system version the app supports. Photo estimates require a camera or a food photo on the device, and a subscription requires a Karbi account and Google Play access. We state the currently supported Android versions on the Google Play listing.
Photo estimates do not work without an internet connection. Our server checks the subscription entitlement on the basis of Google Play's purchase data.
7. Right of withdrawal
As a consumer you may withdraw from the subscription contract without giving reasons within 14 days of concluding it. The deadline starts when the contract is concluded, even if the subscription begins with a trial period.
Cancelling a subscription and withdrawing from it are not the same. Cancelling stops the next automatic renewal; withdrawal affects the contract that has already been concluded.
Your right of withdrawal lapses only on the conditions set out in the law. If this requires your express request for the service to begin immediately and your acknowledgement that the right is lost, then without these we do not treat you as having given up your right of withdrawal. If we have performed a service carrying a payment obligation before the withdrawal, we may only ask for the proportionate amount the law allows. There is no such charge during a free trial period: if you withdraw during the trial, you pay nothing.
You can make your withdrawal declaration on the interface Google Play provides for it, or by a clear declaration sent to hello@karbiapp.com; you may also use the model form in the annex. If Google handles the payment or the refund, we will tell you about the further step needed to settle it. This does not limit your statutory rights.
8. Fair use
Karbi Fotó does not come with a photo allowance that runs out monthly or per subscription period. To keep the service secure, to keep its costs within reason and to prevent automated or bulk use, you can currently start at most 20 photo estimates from one Karbi account on a UTC day.
This is not a separately purchasable allowance, and in ordinary individual use it is not expected to restrict you. If you reach the limit, you can use photo estimates again on the next UTC day; your subscription does not end because of it.
We may change the limit for a justified security, abuse-prevention or capacity reason. If the change adversely affects the ordinary use of the paid service to more than a minor extent, we will tell you in advance and apply your rights concerning the modification of a digital service.
9. If the digital service is defective
Karbi has to work in the way described in the contract and in the law. We provide the updates, including security updates, that are necessary for it to work in conformity with the contract, and we tell you if failing to install an update may have consequences.
If the paid service does not work properly, write to hello@karbiapp.com. We will first try to restore it free of charge, within a reasonable time and without significant inconvenience to you.
If we do not restore the fault, if it occurs again, if it is serious, or if we do not undertake the restoration within a reasonable time, you may ask for a proportionate price reduction or terminate the contract on the conditions set out in the law. We settle the amount due back within the deadline the law prescribes; if Google handled the payment, we take part in Google Play's process for that.
You have these rights independently of Google Play's voluntary refund rules. We do not undertake a separate, voluntary guarantee; this does not affect your statutory rights.
After the contract ends you may ask us to make available the content you created that does not qualify as personal data, where the law requires it. We hand the content over free of charge, within a reasonable time, in a widely used, machine-readable format. (You can also export your log yourself at any time with the CSV export.) Your rights relating to your personal data are described in the privacy notice.
10. What is not allowed
Do not use Karbi unlawfully, to gain unauthorised access to somebody else's account, for automated bulk requests, to bypass security checks or to submit content that infringes the rights of others. Beyond the cases the law permits, do not reverse-engineer or modify the app and the server, and do not try to disrupt them. A label photo must not show a person or personal data that does not belong there.
If we reasonably see that an account is being used for serious or repeated abuse, we may restrict it to the extent necessary. Where possible we first write to explain the reason and give you an opportunity to put things right; we may also act immediately if a security reason, the law or the protection of others makes it necessary.
A restriction does not affect your rights of withdrawal, defective performance or refund.
11. Your content and our rights
Your log and the data you enter remain your content. We use the food photo you send for a photo estimate only to produce the estimate; our server does not keep it after the estimate.
If you send a separate product-label photo to the shared product database, you grant us permission to use the photo only to the extent that you hold the rights needed for this. You give us the permission free of charge and on a non-exclusive basis. It covers checking, processing and storing the submission, displaying it in the product database once it is accepted, and using it to substantiate the origin of the product data shown.
The permission is not irrevocable. You may object to the data processing connected to a label submission as described in the privacy notice. We examine an objection; accepting it is not automatic if an overriding legitimate reason justifies continuing the processing. We handle the submission for the period set out in the privacy notice. The permission ends with deletion, but this does not affect use that was lawful before the deletion. We do not claim copyright in factual data read from the packaging, such as the nutrition values or the barcode.
If in future we also display submitted label photos to other users, and you consider such a photo unlawful or an infringement of your rights, you can tell us at hello@karbiapp.com: describe which content it is, why you consider it unlawful, and how we can reach you. We examine the report, we may remove or restrict the content, and if the decision concerns you, we give reasons for it.
Karbi's name, appearance, own texts and program code are ours or our licensors'. You may use them for personal purposes as part of Karbi, but you may not pass them on and you may not build another service from them. Open-source components are covered by their own licences; you will find these under Licences in Settings.
12. Availability and changes
We aim for the app to work reliably, but we cannot guarantee continuous availability. Sometimes maintenance is needed, or a network or artificial-intelligence provider may go down. Some features may then be temporarily unavailable; where possible we give advance notice of planned, larger maintenance. If the paid service does not work in conformity with the contract, you have the rights described in section 9.
We may modify Karbi for technical, security, legal or operational reasons; a modification may not involve a separate cost for you. If the change adversely affects the use of the paid service to more than a minor extent, we tell you in advance, in a durable form, what changes, when and why. In that case you may terminate the contract free of charge within the deadline set out in the law, unless we continue to give you access to the earlier version unchanged and at no separate cost.
13. Liability
A photo result is an estimate, not a measurement. Check it before you use it, especially where an inaccuracy could cause a health risk. Karbi does not give a diagnosis, a treatment recommendation or an insulin-dosing recommendation, and it does not predict how your body or your blood sugar will react.
We are not liable for a fault or damage caused solely by incorrectly entered data, an unsuitable photo, an unsupported device, a failure to install a necessary update we flagged, or an external network failure that we could not reasonably prevent or avert.
Karbi is made for consumer, personal use. If you use it for business or professional purposes, we are liable for the resulting loss of business profit, loss of revenue or business interruption only where mandatory law requires it.
We do not exclude or limit liability that cannot be excluded under mandatory law, in particular for damage caused intentionally and for damage to life, bodily integrity or health, and liability under mandatory product liability. This section does not limit your rights of withdrawal, defective performance, price reduction, termination or refund.
14. End of the contract
You can stop using Karbi at any time, and you can ask for your account to be deleted in Settings. We delete the personal data belonging to the account in the way described in the privacy notice, except what the law requires us to keep.
Important: deleting your Karbi account does not cancel your Google Play subscription. You have to cancel that separately, in the Subscriptions menu of Google Play, otherwise Google Play keeps charging you.
We may terminate the contract in the cases described in section 10. If we discontinue the Karbi service for good, we will where possible notify you at least 30 days in advance; this deadline does not apply if a legal or security reason, or a reason beyond our control, makes advance notice impossible. Termination does not affect the consumer rights you have already acquired. If an amount for part of a paid period is due back under the law, we settle it together with Google, who handles the payment, under the applicable rules.
15. Changes to these terms
We may modify these terms because of a change in the law, for a security reason, for a new feature or because the operation of the service changes. We give advance notice of a material change, by e-mail or in another durable form: we tell you what changes, why and from when. If the change adversely affects the paid service to more than a minor extent, we also tell you about your right of termination under the law. Continuing to use the app does not on its own take away your mandatory consumer rights.
We show the version number of these terms at the top of the document. The version in force when you accepted it applies to your contract. The current and earlier versions are available at karbiapp.com/aszf.
16. Complaints, disputes, applicable law
Write your complaint to us at hello@karbiapp.com; we answer on the merits within 30 days, and if we reject the complaint we give reasons and tell you where you can turn. We keep the complaint and our answer to it for three years, as the consumer protection act requires.
In a consumer dispute you can turn to a conciliation board. The board with jurisdiction at our registered seat is the Borsod-Abaúj-Zemplén Vármegyei Békéltető Testület (which also has jurisdiction for Heves county; 3525 Miskolc, Szentpáli utca 1.; e-mail: bekeltetes@bokik.hu). You may also request the procedure of the conciliation board with jurisdiction at your home address or place of stay; the list of boards is at bekeltetes.hu. We cooperate in the conciliation board procedure. The consumer protection authority is the government office with jurisdiction at your home address.
Hungarian law applies to the contract. If you live in another EU member state, you still have the mandatory consumer protection rules of your country of residence. We first try to settle the dispute directly; if that does not succeed, you can turn to a conciliation board or to a court. The competent court is determined by the applicable Hungarian and EU rules; this document does not limit the rights you have as a consumer to choose a court.
The original language of these terms is Hungarian; the English version is an informational translation. In the event of a discrepancy the Hungarian text applies, but this does not reduce the rights you have because we offered the service to you in your country of residence and in its language.
